Terms and conditions (“Terms”) are a set of legal terms defined by the owner of a website. They set forth the terms and conditions governing the activities of the website visitors on the said website and the relationship between the site visitors and the website owner. Terms must be defined according to the specific needs and nature of each website. For example, a website offering products to customers in e-commerce transactions requires Terms that are different from the Terms of a website only providing information. Terms provide the website owner the ability to protect themselves from potential legal exposure.

TERMS & CONDITIONS
1. Acceptance of Terms: By using the WeLoads mobile application, website, or services
Weloads, you agree to abide by these terms and associated policies.
2. Nature of Service: WeLoads is a technology platform connecting users with
independent delivery partners. We only arrange the vehicle and driver and are not the
primary carrier or insurer of the goods.
3. Eligibility & Account: Users must be 18 years or older and provide accurate identity
and contact details. Users are responsible for safeguarding account credentials.
4. Booking & Payment: Fares are based on distance, weight, and vehicle type. Payments
can be made via UPI, cards, wallets, or other authorized payment methods.
5. Prohibited Items: Illegal, hazardous, or restricted goods (e.g., narcotics, explosives,
weapons, live animals, chemicals, counterfeit items, or perishable hazardous materials)
are strictly prohibited. Any violation, loss, or legal action arising from the shipment of
such items is solely the user’s responsibility.
6. Packaging & Risk: Users must ensure secure and adequate packaging suitable for
transport. WeLoads does not provide automatic transit insurance. WeLoads is not
responsible for loss or damage caused by inadequate packaging or the inherent
nature of the goods.
7. Partner Relationship: Delivery partners are independent contractors. WeLoads
conducts due diligence but is not liable for their actions beyond reasonable checks.
8. Force Majeure: WeLoads will not be liable for delays or failures in service caused by
natural disasters, strikes, government restrictions, pandemics, vehicle breakdown, or
other uncontrollable events outside of our reasonable control.
9. Conduct & Safety: Any harassment, assault, illegal behavior, or violation of safety norms
will lead to immediate account termination and possible legal action.
10. Limitation of Liability: WeLoads' liability for any direct loss, theft, or damage to goods
proven to be a result of the gross negligence or willful misconduct of the delivery partner
or WeLoads, shall be strictly limited to the lower of:
○ ₹1,000 (Rupees One Thousand only) OR
○ The total freight charges paid for that specific booking.
○ WeLoads shall not be responsible for any indirect, incidental, or consequential loss or
damage. Users are strongly advised to secure third-party insurance for
shipments whose value exceeds this limit.
11. Intellectual Property: The WeLoads name, logo, app design, and all related content are
owned exclusively by the company and may not be copied or reused without written
consent.
12. Governing Law & Jurisdiction: These Terms are governed by the laws of India. Disputes
shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.
